General Terms and Conditions of Sale
Version: May 2025
Applicable to all sales via www.latemluxuryperformance.be and in our showroom in Sint-Martens-Latem.
1. Applicability
These terms and conditions apply to all offers, sales, agreements and deliveries of used vehicles by Latem Luxury Performance BV, unless otherwise agreed in writing. By placing an order or making a purchase, the customer accepts these terms.
2. Offers & Prices
- All offers on the website or in the showroom are non-binding and subject to availability.
- Prices are listed in euros, including VAT (unless otherwise stated), excluding registration fees, taxes, and delivery costs.
- Latem Luxury Performance BV reserves the right to correct prices or specifications in the event of clear errors or misprints.
3. Orders & Payment
- A sale is only binding once confirmed in writing or upon signing of a sales agreement by both parties.
- Unless otherwise agreed, full payment is due upon delivery or collection, either in cash, by bank transfer, or certified payment.
- A deposit may be requested to reserve a vehicle.
4. Delivery & Transfer of Ownership
- Delivery is arranged in consultation with the customer, after receipt of full payment.
- The vehicle remains the property of Latem Luxury Performance BV until payment is complete.
- Delivery times are indicative only and delays do not entitle the buyer to compensation or cancellation.
5. Warranty
- Used vehicles are sold in the condition they are in at the time of sale, with notification of mileage and service history (if available).
- Any remaining manufacturer’s warranty or extended warranty will be specified in the agreement.
- Legal consumer warranty applies according to Belgian law (12 months unless otherwise agreed).
6. Trade-In Vehicles
- Trade-in vehicles are accepted after physical inspection and written valuation by Latem Luxury Performance BV.
- Discrepancies between the customer’s description and the actual condition may lead to a revised trade-in value.
7. Liability
- Latem Luxury Performance BV is not liable for indirect damages, such as loss of income or use.
- In all cases, liability is limited to the amount of the purchased vehicle.
8. Right of Withdrawal
- For distance sales, the customer has no right of withdrawal if the vehicle was personalized or specifically ordered.
- In other cases, the standard 14-day withdrawal right applies, provided the car is not registered or used.
9. Complaints & Disputes
- Complaints must be submitted in writing within 7 days of delivery to: info@latemluxuryperformance.be
- In case of dispute, only the courts of the district of Ghent have jurisdiction. Belgian law applies.
